Buying Property in Dubai From India: LRS and Buyer Checklist

A practical guide for Indian residents buying Dubai property, covering LRS planning, FEMA questions, bank documentation, DLD checks and tax reporting.

Buying Property in Dubai From India: LRS and Buyer Checklist

A resident Indian can use the Liberalised Remittance Scheme for permitted overseas transactions, including acquisition of immovable property, subject to the current rules and the individual’s facts. The property contract and remittance plan need to work together before a reservation is paid.

RBI rules, Indian tax collection and reporting can change. Use an authorised dealer bank and an Indian tax professional for the current treatment; do not rely on a developer’s informal tax explanation.

Understand the two-rule system

Dubai determines whether the property can be owned and registered. India determines how a resident may remit money and report the foreign asset and income. Passing one system does not automatically satisfy the other.

RBI guidance states that a resident individual can remit under LRS to purchase immovable property outside India. Confirm the latest annual limit, permitted funding structure and documentation with the authorised dealer handling the transfer.

Make the payment plan fit LRS timing

An off-plan schedule may cross Indian financial years, involve joint buyers or require a large handover payment. Map every instalment in AED and INR before reserving, including fees and currency tolerance.

Do not assume family members can simply combine allowances without ownership, relationship and compliance consequences. Ask the bank and adviser to review the actual SPA, buyer names and source of each payment.

Prepare bank and tax documentation

Expect the bank to ask for identity, PAN, source of funds, reservation or SPA documents and beneficiary details. Tax collection at source and return reporting depend on current Indian law and the transaction facts.

Keep SWIFT messages, receipts, exchange rates and acquisition costs. These records may matter for foreign-asset disclosure, rental reporting and the future calculation of a gain or loss.

Verify the Dubai property independently

Check the developer, project registration, escrow instructions and unit details through DLD channels. For resale property, verify the title, seller, mortgage position and service-charge status.

Compare the proposed price with actual transaction evidence. A marketing conversion to INR can hide the effect of exchange spreads and future AED obligations.

Plan income, management and exit

If the property will be rented, confirm how income will be collected, documented and reported in India. Budget Dubai management, service charges, repairs and vacancy before quoting a net return.

Before resale, ask an Indian tax adviser how foreign gains, exchange conversion and repatriation records would be handled. Rules at exit may differ from those at purchase.
